A federal judge in San Diego on Friday overturned California's three-decade ban on assault weapons, saying it violates the Second Amendment.
"Under no level of heightened scrutiny can the law survive," U.S. District Judge Roger Benitez said before issuing a permanent injunction that takes effect in 30 days.
Benitez argued the state's definition of illegal military-style rifles bans firearms allowed in other states, depriving California gun owners of their rights.
He compared the AR-15 rifle to a Swiss Army knife, saying it's "a perfect combination of home defense weapon and homeland defense equipment. Good for both home and battle."
California Dems sound off after judge slams 32-year ban on 'assault' weapons as 'failed experiment'.
Gov. Gavin Newsom quickly condemned the ruling, and state Attorney General Rob Bonta promised to appeal.
"Today's decision is fundamentally flawed, and we will be appealing it. There is no sound basis in law, fact or common sense for equating assault rifles with Swiss Army knives - especially on Gun Violence Awareness Day and after the recent shootings in our own California communities," Bonta said in a statement. "We need to take action to end gun violence now. We will fight this ruling and continue to advocate for and defend common sense gun laws that will save lives."

Чего и следовало ожидать. Теперь это дело проведет лет несколько в 9th Circuit.
